Nursing homes and care facilities are required to provide proper care to all residents. Sometimes, nursing homes fail to take care of residents, as in one recent case. A woman has filed a lawsuit in Cook County against Alden Wentworth Rehab & Health Care Center alleging negligent care. The woman was a resident of the facility in 2014, and suffered injuries because the care workers did not properly administer her medication. The woman is requesting a jury trial and damages of more than $50,000.
Violation of Illinois Nursing Home Care Act
The lawsuit cites a failure on the part of the facility, to adhere to the requirements of the Illinois Nursing Home Care Act. The Illinois Nursing Home Care Act is legislation that provides guidelines for resident care in nursing homes. The act details how residents are to be treated and what steps must be taken to resolve difficulties, should they occur. Nursing home management and staff are required to properly attend to and supervise patients, as well as administer medication when needed. Failure to Administer Medication
As you would expect, many residents of nursing homes take medication. Staff members are typically tasked with administering medication to patients when it is needed. In this case, the woman was diabetic, and required insulin medication on a regular basis. According to the lawsuit, the nursing home failed to administer her insulin when it was supposed to be given. The woman further states that the staff did not provide medical treatment when they should have.
Pressure Sores
The woman in this case also suffered from serious pressure sores. Pressure sores, also called bedsores, develop on the body in areas where the skin continually rubs against something, such as bedding. Pressure sores are a sign of nursing home neglect because they should not be allowed to develop. Patients, who are bedridden or unable to move in bed, must be repositioned on a regular basis by nursing home staff. When this fails to happen, sores may develop. As sores worsen, they can become infected and the infection can spread to the bloodstream, causing severe organ damage or death.
Nursing Home Neglect
Neglect in nursing homes may occur for a number of reasons. Care providers may not be properly trained, the facility may be understaffed, or the staff may not be properly supervised. Regardless of the reasons, nursing homes are required to give adequate care to patients and ensure their continued health. The woman in this case suffered severe injuries because of the inadequate care that was provided at the nursing facility. The lawsuit alleges that the facility failed to meet all of the woman’s medical needs while she was a resident there.
